Terms of Service
1. Acceptance of Terms
By accessing or using MixMyPart.com (“Service”), you agree to be bound by these Terms of Service and our Privacy Notice, incorporated herein by reference. If you do not agree, do not use the Service.
The Service is operated by Andrew St. Hilaire, carrying on business as MixMyPart.com, from Winnipeg, Manitoba, Canada (“MixMyPart,” “we,” “us,” or “our”).
We may modify these Terms at any time by posting updated Terms on the Service. Your continued use after changes constitutes acceptance of the revised Terms.
2. Description of Service
MixMyPart provides a browser-based multitrack audio mixing platform that allows authorized users to upload, manage, and share audio recordings through password-protected links.
We reserve the right to modify, suspend, discontinue, or restrict access to any part of the Service at any time without notice or liability.
3. Eligibility
You must be at least 18 years old or the age of majority in your jurisdiction to create an account.
The Service is not directed to children under 13. By using the Service, you represent that you meet these eligibility requirements.
4. Accounts and Security
You agree to:
- Provide accurate information
- Maintain confidentiality of login credentials
- Be responsible for all activity under your account
- Notify us immediately of unauthorized access
We are not liable for losses caused by unauthorized use of your account.
We may suspend or terminate accounts at our sole discretion, including for violations of these Terms.
5. Subscriptions and Payment
Paid plans are offered on a 30-day basis in Canadian Dollars (CAD).
Payments are processed through Stripe. We do not store full credit card numbers.
Plans do not auto-renew unless explicitly stated otherwise at checkout.
We may modify pricing at any time. Changes apply prospectively.
Failure to pay may result in suspension of access.
6. Free Trial
We may offer a one-time free trial (“Free-5”) providing limited functionality. We reserve the right to revoke or modify trial eligibility at our discretion.
7. User Content
Ownership
You retain ownership of content you upload (“User Content”).
Representations and Warranties
You represent and warrant that:
- You own or control all necessary rights
- Your content does not infringe any third-party rights
- Your content complies with all applicable laws
- You have obtained necessary permissions from performers or contributors
License to MixMyPart
You grant MixMyPart a worldwide, non-exclusive, royalty-free, sublicensable and transferable license to host, store, reproduce, process, adapt for technical formatting, transmit, display, and perform your User Content solely for operating, maintaining, improving, and promoting the Service.
This license continues while content is hosted and for a commercially reasonable period after deletion for backup, archival, or legal compliance purposes.
No Confidentiality
We do not guarantee confidentiality of uploaded content.
8. Prohibited Conduct
You may not:
- Upload infringing or unlawful content
- Circumvent security measures
- Use automated systems to overload servers
- Attempt unauthorized access
- Transmit malware
- Reverse engineer the Service
- Use the Service in violation of law
We may remove content or terminate accounts without notice.
9. Intellectual Property
All software, branding, trademarks, designs, and functionality of the Service are owned by MixMyPart and protected by intellectual property laws.
No license is granted except as expressly stated.
10. DMCA and Copyright Policy
If you believe content infringes your copyright, submit written notice including:
- Identification of copyrighted work
- Identification of allegedly infringing material
- Contact information
- Good faith belief statement
- Statement under penalty of perjury
- Physical or electronic signature
We may remove infringing material and terminate repeat infringers.
11. Third-Party Services
We use third-party providers including:
- Supabase (authentication and database)
- Stripe (payment processing)
- Vercel (hosting infrastructure)
We are not responsible for third-party services.
12. Service Availability
The Service is provided on an “as available” basis.
We do not guarantee uninterrupted, secure, or error-free operation.
We may suspend access for maintenance, updates, security, or technical reasons.
13. Disclaimer of Warranties
To the maximum extent permitted by law, the Service is provided “as is” and “as available.”
We disclaim all warranties, express or implied, including:
- Merchantability
- Fitness for a particular purpose
- Non-infringement
- Accuracy
- Security
- Reliability
We do not warrant that:
- The Service will be uninterrupted or secure
- Data will not be lost
- Security breaches will not occur
- Errors will be corrected
You use the Service at your sole risk.
14. Limitation of Liability
To the maximum extent permitted by law:
We shall not be liable for:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, data, or goodwill
- Business interruption
- Unauthorized access or data breach
- Third-party conduct
Regardless of legal theory.
Our total liability shall not exceed the greater of: (a) $100 CAD or (b) the total amount paid by you in the 12 months preceding the claim.
15. Indemnification
You agree to defend, indemnify, and hold harmless MixMyPart, its owner, affiliates, officers, and agents from any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from:
- Your use of the Service
- Your User Content
- Your violation of these Terms
- Your violation of third-party rights
This obligation survives termination.
16. Governing Law and Jurisdiction
These Terms are governed by the laws of Manitoba and the federal laws of Canada applicable therein.
You agree to exclusive jurisdiction of the courts of Manitoba.
17. Time Limitation on Claims
Any claim must be brought within one (1) year after it accrues, or it is permanently barred.
18. Assignment
You may not assign these Terms.
We may assign these Terms without restriction.
19. Severability and Waiver
If any provision is unenforceable, the remainder remains in effect.
Failure to enforce any provision is not a waiver.
20. Force Majeure
We are not liable for delay or failure due to events beyond our reasonable control, including cyberattacks, outages, natural disasters, or government actions.

We do not sell personal information.
3. Legal Basis (Canada – PIPEDA)
We collect, use, and disclose personal information with consent and for purposes a reasonable person would consider appropriate under applicable Canadian privacy law.
4. Data Retention
We retain personal information only as long as necessary to fulfill the purposes described above or as required by law.
You may request deletion of your account and associated data.
Backup copies may persist for a limited period.
5. Data Security
We implement reasonable administrative, technical, and physical safeguards to protect personal information.
However, no system is completely secure. We cannot guarantee absolute security.
6. Data Transfers
Our service providers may store data in Canada, the United States, or other jurisdictions. Information may be subject to the laws of those jurisdictions.
7. Cookies
We use essential cookies for authentication and session management.
We do not use advertising or tracking cookies.
8. Your Rights
Subject to applicable law, you may request:
- Access to your personal information
- Correction of inaccuracies
- Deletion of your information
